Meeting between Admiral Kimmel and the Navy's Judge Advocate General, Admiral Thomas Gatch, December 7, 1944.

Asking for Gatch's legal view if Kimmel should publish what he knew about the Magic intercepts he didn't receive warning him of Japanese intentions towards Pearl Harbor, Gatch replied:


"You would be brought to trial on charges that you had divulged secret matter and you would be convicted, thereby confusing the matter and absolutely discrediting yourself."


OK... so what if Kimmel should publish something about it, but without revealing secret material?

"In that case, The Navy Department would merely state that you are a liar, and you would be unable to prove any of your contentions unless you reverted to the secret matter."


Kimmel asked if there was any way he could clear his name. Gatch told him there was not.
